The following terms and conditions apply to contracts that you conclude with us as a provider (My Fitness Club) via the website www.my-fitness-club.com. Unless otherwise agreed, the inclusion of any of your own conditions used by you is contradicted.

A consumer within the meaning of the following regulations is every natural person who concludes a legal transaction for purposes that are predominantly neither commercial nor their independent professional activity.

The subject of the contract is the sale of digital fitness content and subscription services.

As soon as the respective product is posted on our website, we submit a binding offer to conclude a contract via the online shopping cart system under the conditions stated in the item description.

The contract is concluded via the online shopping cart system. The goods intended for purchase are placed in the shopping cart. After clicking the checkout button and entering your personal data, the order data will be displayed to you as an order overview.

Before submitting the order, you have the opportunity to check the details again. By submitting the order, you declare a legally binding acceptance of the offer, whereby the contract is concluded.

The processing of the order and the transmission of all information required in connection with the conclusion of the contract takes place via e-mail, partly automated.

If you use an instant payment system, you will either be taken to the order overview page in our online shop or forwarded to the website of the provider of the instant payment system.

The contract language is English and German. The complete contract text is not saved by us after conclusion of the contract.

You can only exercise a right of retention insofar as it concerns claims from the same contractual relationship.

The goods remain our property until the purchase price has been paid in full.

The statutory liability rights for defects apply.

As a consumer, you are asked to check the goods immediately upon delivery for completeness, obvious defects, and transport damage and to notify us and the forwarder of complaints as quickly as possible.

Insofar as a characteristic of the goods deviates from the objective requirements, the deviation shall only be deemed agreed if you were informed of the same by us before submitting the contractual declaration.

Austrian law applies. For consumers, this choice of law applies only insofar as the protection granted by mandatory provisions of the law of the consumer's habitual residence is not withdrawn.

The place of performance for all services and the place of jurisdiction is our registered office, provided you are not a consumer but a merchant.

The provisions of the UN Convention on Contracts for the International Sale of Goods explicitly do not apply.

Alternative Dispute Resolution: The European Commission provides a platform for out-of-court online dispute resolution accessible at https://ec.europa.eu/odr. We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

The technical steps to conclude the contract, the conclusion of the contract itself, and the correction options are carried out in accordance with the regulations in our General Terms and Conditions (Part I).

The complete contract text is not saved by us. Before sending the order, the contract data can be printed out or electronically saved via the online shopping cart system.

The essential characteristics of the goods and/or services can be found in the respective offer on our website.

The prices listed in the respective offers as well as the shipping costs represent total prices. The incurred shipping costs are not included in the purchase price.

If delivery is made to countries outside the European Union, additional costs may apply, such as customs duties, taxes, or money transfer fees.

Incurred costs of money transfer are to be borne by you in cases where the delivery takes place in an EU member state, but the payment was initiated outside the European Union.

The payment methods available to you are shown under a correspondingly designated button on our website.

Unless otherwise specified for the individual payment methods, the payment claims from the concluded contract are due for payment immediately.

When paying by credit card, your credit card account will be charged at the time of the order.

The delivery conditions, the delivery date, and any existing delivery restrictions can be found under a correspondingly designated button on our website.

If you are a consumer, it is regulated by law that the risk of accidental loss of the sold item during shipment only passes to you upon handover of the goods.

Liability for defects is governed by the "Warranty" provision in our General Terms and Conditions (Part I).
